Terms of use

The rules for using GaariBazar. Clauses 4, 5 and 6 are the important ones: we are not party to any sale, a bid is an expression of interest rather than a contract, and no money passes through this site.

1. Who we are and what this site is

GaariBazar is an advertising and introduction platform for used cars in Pakistan. We publish advertisements and, when a buyer and a seller want to talk to each other, we put them in contact.

That is the whole service. We do not own the cars, we do not inspect them mechanically, we do not value them, we do not broker the sale, we do not handle the money and we do not transfer the registration. Using this site means you accept that.

2. Your account

  • One account per mobile number. The mobile number is the account. You may not hold a second account on a second number in order to post the same car twice, to bid against yourself, or to come back after a suspension.
  • You must be 18 or older and the details you give must be true.
  • The account is yours and you are responsible for what happens on it, including anything somebody else does with your phone.
  • Email is optional. If you do not give one, everything reaches you by SMS and on the site, so keep the number current.

3. Advertisements

  • Every ad is reviewed by a person before it appears, usually within one working day. Nothing goes live automatically.
  • We may reject your ad, and we will tell you which of the seven reasons applies and add a note if there is more to say.
  • We may edit your ad — correct an obviously mistyped year or mileage, fix a category, or remove a phone number from the description — rather than reject it. We will not change your price or rewrite your description.
  • We set how long it runs: 1 week, 2 weeks or 1 month, decided at approval. When it expires the ad comes down, and a renewal goes through approval again.
  • You must have the right to sell the car you advertise, and everything you say about it must be true — particularly the mileage, the number of owners, the paint condition and whether the original file is available.
  • We may take an ad down at any time, with the reason given.

4. We are not party to any sale

A sale agreed through this site is a private contract between the buyer and the seller. GaariBazar is not a party to it, not an agent for either side, and not a guarantor of anything.

In particular we give no warranty and accept no liability for:

  • the condition, mileage, accident history, paint or roadworthiness of any car;
  • whether the seller owns the car or has the right to sell it;
  • whether the original file, the registration book or any other document is genuine;
  • anything a buyer or a seller says to the other, on this site or off it;
  • money paid between a buyer and a seller, in any direction, for any reason.

Check the car and check the file yourself. If money matters to you, have the car inspected by a workshop and verify the documents at the excise office before you pay anything.

5. Bids are expressions of interest, not binding contracts

Read this one before you bid.

A bid placed in a GaariBazar auction is an expression of interest. It is not an offer capable of acceptance, and it does not create a contract of sale between the bidder and the seller. When an auction closes, the only thing that happens is that we put the highest bidder and the seller in contact with each other. Whether they then agree a sale, at what price, and on what terms, is entirely up to the two of them.

What follows from that:

  • A seller is not obliged to sell to the highest bidder, or to anybody.
  • A bidder who wins is not legally obliged to buy, and owes nothing to GaariBazar.
  • Neither side can sue the other — or us — over an auction result.

That is the legal position. The practical position is different: we expect a bidder to stand behind his bid, a seller relies on it, and a member who repeatedly bids and then disappears will have his account suspended under clause 8. Bidding is free and there is no deposit, so the only thing that makes an auction work is that people mean what they bid.

We may also cancel or extend an auction, or reject a bid, where there is evidence of manipulation — a seller bidding on his own car, two accounts run by one person, or a bid so far out of line that it is plainly not real.

6. We hold no money and provide no escrow

No payment of any kind passes through GaariBazar. We do not take deposits, we do not take booking amounts, we do not hold funds in escrow, we do not take a commission at the point of sale and we have no payment gateway. Buyers pay sellers directly, in person, and no part of that transaction is visible to us or recorded by us.

Because we never hold the money, we cannot reverse a payment, cannot refund one and cannot recover money you have sent to anybody. If you send money before you have seen the car, that risk is entirely yours.

GaariBazar will never ask you to pay us in order to buy, sell or bid on a car. Anyone who contacts you claiming to be us and asks for a transfer is not us. Tell us through the contact page.

7. Transfer of ownership is the seller’s responsibility

Registering the car into the buyer’s name at the excise office is the responsibility of the seller and the buyer between them, and by law it starts with the seller. GaariBazar plays no part in it, files nothing on anyone’s behalf and holds no documents.

Until the transfer is complete the car remains registered to the seller, which means token tax, challans and anything else that attaches to the registration remain his problem. Buyers: do not leave without agreeing when and how the transfer happens.

8. What you may not post or do

  • Advertise a car you do not own or have no right to sell, or one that is stolen, seized, subject to an unpaid lease or otherwise not free to be sold.
  • Misstate the mileage, the model year, the number of owners, the paint condition or the file status. Rolling back an odometer is a crime and we will report it.
  • Put a phone number, an email address, a WhatsApp link or a web address in the description or in a photograph. The number behind a sign-in is the whole registration model.
  • Post the same car more than once, or from more than one account.
  • Advertise anything that is not a car: parts, number plates, services, loans, jobs or anything unrelated.
  • Use photographs you do not have the right to use, including photographs lifted from another advertisement.
  • Scrape, copy or republish listings, or run automated software against the site.
  • Harass, threaten or defraud another member, or attempt to take a conversation off the site in order to do so.
  • Bid on your own car, bid from a second account, or place bids you have no intention of standing behind.

9. Suspension and removal

We may remove an ad, close an auction, suspend an account or delete it, where a member breaks these terms or where we reasonably suspect fraud. For a first, obviously accidental breach we normally warn first and explain what to fix. For odometer fraud, a stolen car, a fake file or a fake CNIC we suspend immediately and without warning, and we report it.

A suspended member is told which clause he broke and may reply through the contact page; we read every reply. Creating a new account on a different number to get round a suspension is itself a breach of clause 2.

10. Your content, and ours

Your photographs and your description stay yours. By posting them you give GaariBazar permission to display them on the site and to use them to promote the listing — in search results, on social media and in the site’s own advertising — for as long as the ad runs and for a reasonable period afterwards in archives and search caches, which we do not control.

The site itself — its design, its code, its structure and its data as a collection — belongs to us. Copying listings in bulk is prohibited under clause 8.

11. Changes, law and how to reach us

We may change these terms. A material change is posted on this page with a new date and, where we have an email address, sent to members. Continuing to use the site after that means you accept the new version.

These terms are governed by the laws of Pakistan, and the courts at Lahore have jurisdiction.

Questions about anything on this page: the contact page, answered within one working day.

Draft — not yet dated. The live version carries the date it took effect.
